The purpose of this Legal Notice is to regulate the principles of access and the General Conditions of Use of the Web Site. www.roxall.es (hereinafter referred to as the "General Conditions of Use").
  1. GENERAL INFORMATION ABOUT THE OWNER OF THE WEBSITE.

1.1. In compliance with the duty of information contained in Article 10 of Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce ("LSSI"), the following circumstances are hereby stated:

  1. ACCESS AND CONDITIONS OF USE OF THE WEB SITE.

2.1. The uses of the Web Site are free and free of charge, without prejudice to the cost of connection through the corresponding telecommunications network that access has for the User, and provided that the User complies with the terms of this Legal Notice, current legislation, good customs and the usually accepted behaviors in the Internet environment. By accessing and using the Website, the User expressly declares that he/she has read, understands and accepts without reservation the Legal Notice, as well as the Privacy Policy in force at all times. In the event that the User does not accept the terms and conditions of use described below, he/she shall refrain from using the Website.

2.2. Visiting the Website does not necessarily imply that the User must register or provide personal data. However, if in any case the User should provide personal data, he/she will be previously informed of the conditions of treatment in accordance with the provisions of the Privacy Policy of the Website.

2.3. In the event that the User will be provided with a password, the User will be solely responsible for its custody and proper use, undertaking to make diligent and confidential use of it, and not to transfer its use to third parties. The User shall be responsible for the unlawful use of the services provided on the Website by any illegitimate third party who uses the password for this purpose due to a non-diligent use or loss of the same by the User.

Likewise, ROXALL reserves the right to temporarily or permanently interrupt any of the services provided through the Website, without prior notice, as well as the right to terminate the relationship with the User if it detects any abnormal use.

2.6. The User undertakes to make appropriate use of the Content that ROXALL offers through the Website. For illustrative purposes only and without being exhaustive, the following is a list of those behaviours considered inappropriate and, therefore, prohibited uses of the Website:

      • Attempt to access and, where appropriate, use the e-mail accounts of other users and modify or manipulate their messages.
      • Use the Contents and, in particular, information of any kind obtained through the Web Site to send advertising, communications for the purpose of direct sales or any other commercial purpose, unsolicited messages addressed to a number of persons regardless of their purpose, as well as to disclose in any way such information.
  1. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

ROXALL is the owner or has the corresponding license over the intellectual and industrial property exploitation rights of the Website, as well as the intellectual, industrial and image property rights over the contents available through the Website (including, but not limited to, images, sound, audio, video, software or texts; trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), and consequently enjoys the protection provided for in the applicable regulations on industrial and intellectual property. The design, images, maps, graphics, trademarks, labels, distinctive signs or logos of ROXALL, frames, banners, software and its different codes, source and object, of this Website are the property of ROXALL, which legitimately holds exclusive rights to exploit them.

    • In no case shall it be understood that the access and navigation of the User implies a waiver, transfer, license or total or partial transfer of such rights by the Owner of the Website. Users may make private use of the Website and the Service, but in no case may make commercial use of it, or alter its elements, reproduce them beyond their private use, distribute or communicate them publicly.

4.1. Exemption from liability for inaccuracy or falsity of the data provided by the User.

ROXALL shall in no case be liable for the inaccuracy, falseness or untruthfulness of the personal data and information provided by Users for registration on the Website.

4.2. Exemption from liability for improper use of the Web Site.

ROXALL shall in no event be liable for damages of any kind, arising directly or indirectly from failure to read the Legal Notice, or failure to comply with the obligations set forth therein.

4.3 Disclaimer of liability for the operation of the Web Site.

ROXALL does not guarantee the total updating, accuracy and/or availability at all times of the Website or the services provided through it, although it states that it has adopted all necessary measures, within its possibilities and the current state of technology, to ensure the continued operation of the Website and to prevent the existence and transmission of viruses and other harmful components.

The services provided through the Website may be interrupted due to circumstances of various kinds. In this case, ROXALL shall not be liable in any case for any damages that the interruption, suspension or unavailability may cause to the User or his equipment.

The User accepts that the use of the Website shall be at his sole risk and that ROXALL shall not be liable for any damages caused by the lack of availability or continuity of the Website, access failures, breach of its security systems, suitability for a particular purpose or compliance with the User's expectations or needs.

4.4 Disclaimer of liability for content hosted on web pages accessible from the Website.

ROXALL does not guarantee the accuracy, quality, reliability or morality of the data, programs, information or opinions, whatever their origin, circulating on its network or on the networks to which the User may have access through the Website and which are beyond its will and/or control.

In the event that the Website may contain links to other portals not managed by ROXALL, ROXALL states that it has no control over such portals or websites, nor is it responsible for the content or privacy policies of such portals or websites, and the User assumes sole responsibility for browsing through them.

No link may be established to the Website from any other website without the express prior consent of ROXALL.

  1. MODIFICATION OF THE GENERAL CONDITIONS.
    • These General Conditions of Use may be modified at any time by ROXALL by making available to the User an updated version of the Conditions in force at any given time on the Website. The use of the Website by the User shall imply acceptance of the General Conditions of Use, the Legal Notice and the Privacy Policy and Cookies Policy of the Website in force at any given time.
    • Users acknowledge that ROXALL may, at any time, modify these Terms and Conditions or introduce new conditions of use, simply by posting them on the Website, and even cancel the service by giving prior notice on the Website whenever possible. It is the User's responsibility to periodically check the General Conditions of Use, the Legal Notice and the Privacy Policy and Cookies Policy of the Website to keep informed about the possible existence of changes.
